2. ARTICLE: INFORMATION ABOUT THE BUYER

 

The Customer (Buyer, the natural person consumer who shops from the Seller's website www.minipodyum.com. The address and contact information provided by the buyer in the invoice and communication details are taken into consideration.)

 

3. ARTICLE: SUBJECT

The subject of this Pre-Information Form is to inform the Buyer in accordance with the provisions of the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts published in the Official Gazette dated November 27, 2014, regarding the sale and delivery of the product(s) specified below, including their nature and selling price.

 

4. ARTICLE: BASIC FEATURES OF THE CONTRACTED PRODUCT AND PAYMENT INFORMATION

The type, quantity, brand/model, color, unit price(s), and selling price, as well as payment information, constitute the information available at the time of ordering.

The type and nature of the products (goods/services), quantity, brand/model, color, unit price(s), selling price, payment information, and delivery information, including the delivery location specified by the BUYER, constitute the information available at the time of ordering.

 

5. ARTICLE: DELIVERY TIME OF THE PRODUCT/SERVICE

Delivery will be made as soon as possible after the stock is available and the payment for the goods is credited to the Seller's account. Delays may occur due to force majeure events such as natural disasters, inclement weather, etc. The Seller delivers the goods/services within 30 (thirty) days from the date of the order.

 

6. ARTICLE: DELIVERY OF THE PRODUCT/SERVICE

The delivery of the product/service is made to the address requested by the buyer. If the buyer requests delivery to someone else or to a different address from their own, delivery is made accordingly. Delivery costs are borne by the Buyer. If the Seller has stated on the website that delivery charges will be covered by the Seller for purchases above the announced amount or in some campaigns, the delivery charge will be covered by the Seller. The delivery of the product/service is carried out by courier companies.

The signed copy of the distance sales contract must be delivered to the Seller for the delivery of the ordered product/service, and the payment must be made in the payment method preferred by the Buyer. If the price of the product/service is not paid for any reason or canceled in the bank records, the Seller is deemed to have been relieved of the obligation to deliver the product/service.

 

7. ARTICLE: PAYMENT METHOD

Payments can be made by credit card, EFT, or bank transfer.

 

8. ARTICLE: VALIDITY PERIOD

The prices listed and announced on the website are the selling prices. The announced prices and promises are valid until they are updated and changed. Prices announced for a certain period remain valid until the end of the specified period. However, in the case of price discrepancies due to typographical errors, or if the real price of the product/service differs from the one announced due to delayed notification from the supplier, the current price notified by the Seller to the customer will be considered valid. In case of errors, if more than the product/service price is charged, the difference will be refunded. If the actual price of the product/service differs from the announced price, the Buyer will be informed of the actual price. Sales are made at the actual price upon the customer's request or the sale is canceled.

 

9. ARTICLE: RIGHT OF WITHDRAWAL

9.1. In accordance with Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts dated November 27, 2014, the CONSUMER BUYER has the right to withdraw from the contract without specifying any reason and without paying any penalties within 14 (fourteen) days from the date of delivery of the Product.

9.2. The withdrawal period starts from the day the Contract is established for the Service; for the Product, it starts from the day the CONSUMER BUYER or the third party designated by the CONSUMER BUYER receives the Product. However, the CONSUMER BUYER can exercise the right of withdrawal during the period from the establishment of the Contract to the delivery of the Product.

9.3. In determining the withdrawal period:

• In the case of Products delivered separately but forming a single order, the day the CONSUMER BUYER or the third party designated by the CONSUMER BUYER receives the last Product,

• In the case of Products consisting of multiple parts, the day the CONSUMER BUYER or the third party designated by the CONSUMER BUYER receives the last part,

• In cases where the Product is regularly delivered for a specified period, the day the CONSUMER BUYER or the third party designated by the CONSUMER BUYER receives the first Product is taken into account.

9.4. In cases where the delivery of the Product and the provision of the Service are combined, the withdrawal provisions regarding the delivery of the Product apply.

9.5. The CONSUMER BUYER is obliged to notify the SELLER in writing or by durable medium before the expiration of the withdrawal period that they are exercising their right of withdrawal.

9.6. Unless the SELLER makes an offer to reclaim the goods, the CONSUMER BUYER must return the Product to the SELLER within 14 (fourteen) days from the date they notify the exercise of the right of withdrawal. The CONSUMER BUYER must return the Product to the SELLER with its full and complete packaging, protective, additional, and complementary accessories, and if any, warranty certificate, usage instructions, and all necessary documents, including the invoice issued regarding the Product. The CONSUMER BUYER acknowledges and declares that they are responsible for any changes and deterioration that occur due to non-compliant usage with this provision and that the Buyer has the right not to accept the returned products that have undergone such changes and deterioration.

9.7. The SELLER is obliged to refund all payments received, including all expenses incurred, including the delivery expenses to the CONSUMER BUYER, within 14 (fourteen) days from the date the notification of the exercise of the right of withdrawal is received.

9.8. The CONSUMER BUYER shall not be liable for any changes and deterioration arising from the proper use of the Product within the withdrawal period. The CONSUMER BUYER acknowledges and declares that they are responsible for any changes and deterioration that occur due to non-compliant usage with this provision and that the Buyer has the right not to accept the returned products that have undergone such changes and deterioration.

9.9. The SELLER undertakes and declares to make all refunds specified in Article 9.3 to the CONSUMER BUYER in a single transaction without imposing any cost or obligation on the CONSUMER BUYER, in a manner compatible with the payment instrument used by the CONSUMER BUYER when purchasing.

9.10. When exercising the right of withdrawal, if the CONSUMER BUYER returns the goods using the carrier specified for return in the pre

 

-information form provided by the SELLER, subject to the exceptions specified in the Contract, the CONSUMER BUYER is obliged to bear the return costs up to the refund costs, provided that they do not exceed the return costs. If the SELLER does not specify any carrier for return in the pre-information, no fee can be charged for the return costs from the CONSUMER BUYER. If the carrier specified in the pre-information is not present at the location of the CONSUMER BUYER, the SELLER is obliged to ensure the collection of the Product to be returned by the CONSUMER BUYER without any additional expense. If the carrier specified in the pre-information is present at the location of the CONSUMER BUYER and the CONSUMER BUYER returns the Product with a different carrier, the CONSUMER BUYER is obliged to bear the return costs.

9.11. Cases where the Right of Withdrawal cannot be used: The CONSUMER BUYER cannot use the right of withdrawal for products that fluctuate in price depending on financial market fluctuations and are not under the control of the seller or supplier, products prepared according to the consumer's wishes or personal needs or made specific to the consumer by making changes and additions to the product, perishable or expireable goods, goods whose protective elements such as packaging, tape, seal, package have been opened after delivery, products that are not suitable for return for health and hygiene reasons after delivery, products that are mixed with other products after delivery and cannot be separated due to their nature, products related to the delivery of periodicals such as newspapers and magazines other than those provided under a subscription agreement, products related to the provision of leisure activities for a specific date or period, including accommodation, transportation of goods, car rental, food and beverage supply, and entertainment or recreation, and non-material products provided to the consumer instantly via electronic environment or instantly delivered to the consumer, in accordance with the contract, the consumer cannot exercise the right of withdrawal for the products and services they purchase to evaluate the leisure time they spend.

 

10. ARTICLE: VALIDITY

This pre-information form will be considered to have entered into the Distance Sales Contract stage after being read and accepted by the Buyer in electronic form.

 

11. ARTICLE: AUTHORIZED COURT

The consumer can file complaints and objections with the Consumer Arbitration Committee or the consumer court within the monetary limits determined annually by the Ministry of Customs and Trade, where the consumer purchased the goods or services or where the consumer resides, subject to the provisions of Law No. 6502 on Consumer Protection.

 

12. ARTICLE: FINAL PROVISIONS

In case it is determined or suspected that the documents and information provided for the order are incomplete, counterfeit, and/or incorrect, or if there is a suspicion that the order has been made maliciously and/or for commercial and/or profit purposes, the Seller reserves the right to suspend and/or cancel the order to conduct necessary investigations, provided that the Buyer is informed. In case of cancellation, the refund process may be made to the Buyer provided that the payment process is communicated to the Buyer.

 

13. ARTICLE: EXCEPTION

The provisions of the articles in this pre-information form, which provide legal protection to consumers pursuant to Law No. 6502 on Consumer Protection, will be effective only in cases where the buyer is a Consumer; in cases where the buyer does not fit the definition of a Consumer under Law No. 6502, the relevant articles will not be valid between the parties.

The Buyer acknowledges, commits, and declares that they have read and understood the Pre-Information and provided necessary confirmation in electronic form, in accordance with Articles 48 and 2 of Law No. 6502 and Articles 5, 6, and 7 of the Distance Sales Regulation.
